1. Introduction

Welcome to Litigation Labs ("Company", "we", "our", "us"). These Terms and Conditions ("Terms") govern your use of our website located at litigationlabs.ai (the "Site") and our managed paralegal services (collectively, the "Services").

 

By accessing this Site or purchasing our Services, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these terms, you must strictly prohibited from using our Site and Services.

 

2. Nature of Services (Disclaimer)

LITIGATION LABS IS NOT A LAW FIRM.

 

No Attorney-Client Relationship: Your use of our Services does not create an attorney-client relationship between you and Litigation Labs or any of our employees.

 

Paralegal Support Only: We provide managed paralegal support and legal operations assistance. Our work is performed under the specific direction and supervision of you, the authorized user (who must be a licensed attorney or a pro se litigant representing themselves in accordance with applicable laws).

 

No Legal Advice: We do not provide legal advice, opinions, or recommendations. We do not sign pleadings, represent clients in court, or make strategic legal decisions. You represent and warrant that you will review all work product for legal accuracy and compliance with local rules before use.

 

3. Accounts and Registration

To access certain features of the Services, you may be required to register for an account. You agree to:Provide accurate, current, and complete information during the registration process.Maintain the security of your password and accept all risks of unauthorized access to your account.Notify us immediately if you discover or suspect any security breaches related to the Services.

 

4. Intellectual Property Rights

A. Our Intellectual Property

Unless otherwise indicated, the Site and Services are our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.

B. Your Work Product (Work Made for Hire)

Upon full payment of all applicable fees, Litigation Labs assigns to you all right, title, and interest in the specific documents, research, and deliverables created specifically for you ("Work Product"). You retain full ownership of any confidential client data you upload to our system.

 

5. Prohibited Activities

  • You may not access or use the Site for any purpose other than that for which we make the Site available. As a user of the Site, you agree not to:

  • Systematically retrieve data: Scrape or compile data from the Site to create a collection, compilation, database, or directory without written permission from us.

  • Unauthorized Use: Use the Services to provide legal advice to third parties without proper licensure.

  • Reverse Engineering: Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Site.

  • Harassment: Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Services to you.

  • Viruses: Upload or transmit (or attempt to upload or transmit) viruses, Trojan horses, or other material that interferes with any party’s uninterrupted use and enjoyment of the Site.

 

6. Payment and Refund Policy

Payment: You agree to pay all fees or charges to your account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable.Subscription Renewal: If you subscribe to a recurring service, your subscription will automatically renew unless canceled at least 24 hours before the end of the current billing period.

 

Refunds: Due to the labor-intensive nature of managed paralegal services, all sales are final. We do not offer refunds for work already performed. If you are dissatisfied with a deliverable, you must notify us within five (5) business days, and we will make commercially reasonable efforts to revise the work to your satisfaction.

 

7. Use of Artificial Intelligence

Litigation Labs utilizes advanced technologies, including Artificial Intelligence (AI) and Machine Learning (ML), to assist in legal research, document organization, and drafting.

 

Human in the Loop: While AI tools are used to enhance efficiency, all final work product is reviewed by human paralegal professionals before delivery.

 

Verification: You acknowledge that AI tools can occasionally produce errors ("hallucinations"). You are solely responsible for verifying all citations, facts, and legal arguments in the Work Product.

 

8. Limitation of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.

 

9. Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your use of the Services; (2) your violation of these Terms; (3) your violation of applicable laws or regulations (including Unauthorized Practice of Law statutes); or (4) any Client Data you upload that violates the rights of a third party.

 

10. Dispute Resolution

Binding Arbitration

If the Parties are unable to resolve a Dispute through informal negotiations, the Dispute (except those expressly excluded below) will be finally and exclusively resolved by binding arbitration. The arbitration shall be commenced and conducted under the Commercial Arbitration Rules of the American Arbitration Association ("AAA").Governing LawThese Terms shall be governed by and defined following the laws of the State of [Insert State], without regard to its conflict of law provisions.
